If i walked into the hospital room tonight and shot Terri Schiavo in the head, would i be guilty of:
1. No crime
2. Cold-blooded Murder
3. Destruction of private property
4. Physician assisted suicide (and practicing medicine without a license)
And if you were the judge, how would you sentance me?
Posted by: Marty at March 24, 2005 6:43 PMThe way I figure it Marty, at least according to Kentucky criminal law, you would indeed be guilty of murder. You might still be able to get yourself acquitted using a "lesser of two evils" defense, but that would probably be stretching it. That defense is usually only valid when a person commits a crime when it would have resulted in harm to yourself by not committing the crime. Still, if you could convince a jury to believe that Terri would have indeed be suffering a horribly painful death otherwise that might be your best defense.
But you know that slack-jawed jack-knave that calls himself her husband would be all outraged and indignant about it, not to mention that (ahem) honorable Judge that gave her the death sentence in the first place.
